The night sky is being zoned as if it were vacant spectrum. It is not. SpaceX filed a million-satellite compute system. Blue Origin's Project Sunrise is 51,600. Starcloud filed 88,000. Cowboy Space filed Stampede at 20,000. Startup Orbital filed 100,000. Reflect Orbital hopes for 50,000 mirrors. Those are one pile of integers. The American Astronomical Society's petition to deny the million-sat file is the first object that treats the pile as a commons. The FCC's 9 July Eärendil-1 order is the first object that says optical astronomy is outside the building.
Three inventories share an altitude. Photons that hit a telescope. Air that a VLEO scoop wants to ionise. Darkness that Reflect wants to meter by the minute. None of those are in a raise deck. All of them are in dockets this year. Flatten the integers into one space trade and you get a false headline. Do not flatten them.
AAS is the exposed petition
The petition is the letter the year actually produced. A million sunlit compute nodes, larger than Starlink because of solar arrays and radiators, would saturate Rubin frames, raise the infrared background, lift the radio floor through aggregate UEMR (OVRO-LWA already sees a haze), and scale re-entry casualty math past what the Commission has accepted. Hainaut's model, on the mirror side, is 50,000 Reflect-class objects and plus-200 to plus-300 percent on the scattered night-sky background. A petition is not a denial. A haze at OVRO-LWA is not a zone.
A photon is not a radio
The Commission has a habit. It licences the radio. It waives milestones when the applicant says the system is optical-first and therefore not warehousing spectrum. It then says the photon that is not a radio is someone else's review. That habit is why a filings market can clear. It is also why a grant with no brightness, heat, or disposal condition would end the scepticism on this page. The 9 July order put astronomy out of scope for one licensed reflector. That is a jurisdictional sentence. It is not a metered ground spot.
Eärendil-1 is licensed. Astronomy is out of scope. A public ground spot by the end of June 2027 is still the dated object. Until a spot is metered, darkness-for-sale is a prospectus, not a minute a buyer can book.
An integer is not a zone
DARPA Otter and Kreios want to live at 90 to 300 kilometres, where the air is thick enough to be fuel and thick enough to be a de-orbit. On 4 August, Kreios picked a commercial air-breathing bus. That is a vehicle sentence. It is not a 30-day VLEO hold. A year-plus Otter flight with usable intake thrust is still the 2028 object. Those two scoops share the same shoreline as the photons and the mirrors. They are not a third sector.
A phone that works because 320, or 5,105, or 45 more birds went up is a connectivity print. A sky that no longer has a dark minute is a commons print. Power on the ground is the same fight with a county board: prove-your-own-power, IRAS, a queue in years. There is no county board at 600 kilometres. There is a comment cycle and a petition.
What a file cannot do
A docket is not a gold print. A hall that becomes illegal does not make a million-sat file into a substitute that can fly. Cross-asset does not care which integer cleared. AI abundance cares only if the substitute is a file that cannot fly. Do not merge those.
A refutation would look like this: Eärendil-1 meters a public ground spot by the end of June 2027; or the Commission denies the million-sat compute file, or grants it with astronomy or disposal conditions that withhold operations; or Otter holds a year-plus flight with usable intake thrust, or a Kreios-class bus holds VLEO for 30 days, by the end of 2028. An unconditioned grant of the million-sat file would end the scepticism. A 9 July licence for one reflector is none of those.
The honest uncertainty is which inventory gets a number first. If Eärendil meters a spot and the million-sat file still has no astronomy condition, darkness is inventory and the commons is not. If the Commission attaches brightness, heat, or disposal conditions that withhold operations, the petition did the work and the integers stay paper. If Otter or Kreios holds the air and the mirrors are still a hope, the shoreline is a vehicle, not a billboard. Those three sentences can live in the same year. A million-sat integer is a fact about one filing. Fifty thousand mirrors are a fact about one model. Neither is a zoned sky.
